Contract Review

DELIVERY 

Let Destiny Design is responsible for the prompt delivery and setup of the ceremony and /or event/reception location listed above. Delivery stops for your wedding/event will include one location unless otherwise stated in the agreement.

 

SUBSTITUTIONS + FLORAL DAMAGES

Let Destiny Design Inc. reserves the right to make substitutions in the event the flowers received are not of suitable quality for your event or are not available at that time. Any substitutions made will be in keeping with the style, texture, and color scheme of your event/wedding.  

Customer agrees to assume the risk of and hold Let Destiny Design Inc. harmless for any stains, discoloring or damage caused by the flowers themselves to any properties such us, but not limited to, furniture, dresses, suits, tuxes, accessories, handbags, linens, runners, napkins, handkerchiefs, etc.

 

REDUCTION/ADDITION POLICY 

Additions may be made up to seven days prior to your event and will be invoiced separately which must be paid at the time of addition. Let Destiny Design Inc. Is not required to allow additions inside of 14 days prior to your event.

After booking, you may only reduce your order by 20% of the total dollar amount.

Within 90 days of your event, you may only reduce your order by 15%.

Within 30 days of your event, you may only reduce your order by 10%.

All reductions must be made prior to 14 days before your event. If your reductions fall below what has already been paid, monies paid/payments are non-refundable.  

RENTAL ITEMS 

Items rented from Let Destiny Design Inc. Will be setup by Let Destiny Design Inc. unless otherwise stated. Client assumes all responsibility for any loss and/or damage of rented items and will be billed for any loss and/or damages up to the full replacement cost of the item. Unless the customer purchases our Breakdown and Pickup Service, all rental items must be returned to the Let Destiny Design Inc. office in Fernandina Beach by the Tuesday following your event in order to avoid paying any additional rental fees and/or replacement charges. Replacement charges will cover the cost of the rental item itself along with any shipping fees necessary.

  • Unlimited emails with an LDD designer.

  • One Finalization Meeting

 

WEATHER & DAMAGE 

Let Destiny Design Inc. is not responsible for damage to flowers caused by weather conditions, including but not limited to heat, humidity, snow, freezing temperatures, wind, breezes, etc. The customer assumes responsibilityof all items included but not limited to flower arrangements, and rental items after delivery and/or customer pickup has been fulfilled. 

PAYMENTS 

All payments maid, including the initial retainer of 50% is non-refundable. Your event will NOT be added to our calendar, nor will your event date be reserved until the retainer is paid and the signed contract is received. The retainer reserves the date of your event and will be applied to the final total/balance. Checks may be made payable to Let Destiny Design Inc., and mailed to 96041 Nassau Place, Yulee FL 32097. In the event that a check is returned, a $25 returned check fee will be assessed to the customer.  

Your final balance must be paid two weeks prior to your event. If your remaining balance is not paid by two weeks prior to your event, we will consider your event cancelled and it will be treated as such.

 

CANCELLATION + RESCHEDULE POLICY 

In the event of cancellation, the retainer as well as any monies paid thereafter are non-refundable. 

In the event that the customer wants to postpone their event/order due to a force majeure event, one free direct date transfer may be applied, if the event needs to be rescheduled more than once, a $250 Rescheduling Fee will be applied. If flowers have NOT been ordered and/or paid for by Let Destiny Design Inc. then your payments may be applied to a new date if the desired date is available, and within six months from the original event date. If flowers HAVE been ordered and/or paid for by Let Destiny Design Inc. any payments may be applied to a new date if the desired date is available and within the calendar year of the original event date, and a "Fresh Goods Replacement Fee" will be applied to the contract in order to cover the expenses of having to repurchase the fresh goods for the new date.

In the event that the customer chooses to postpone their wedding not related to force majeure events, there will be a $250 rescheduling fee to reserve the new date, pending availability.

Floral and/or design services both fresh and/or silk rendered by designers outside of our management will be considered a cancellation and will be treated as such. Finished product and designs from Let Destiny Design Inc. will NOT be mixed with designs from outside sources. Absolutely no exceptions will be made. Let Destiny Design Inc. reserves the right to cancel this agreement/contract at any time if obligations cannot be met. 

PHOTO RELEASE

Let Destiny Design Inc. Staff can take photos of the flowers at the event and can use photos and/or video from the professional/non-professional photographer and/or videographer for your event. Let Destiny Design Inc. Has the right to use said photos and/or video for the following, but not limited to social media, blog, advertisements, print, web and website use. 

FORCE MAJEURE

No party shall be liable or responsible to the other party, nor be deemed to have defaulted under or breached this Agreement, for any failure or delay in fulfilling or performing any term of this Agreement (except for any obligations to make payments to the other party hereunder), when and to the extent such failure or delay is caused by or results from acts beyond the impacted party’s (“Impacted Party”) control, including, but not limited to, the following force majeure 

events (“Force Majeure Events”): (a) acts of God; (b) a natural disaster (fires, explosions, earthquakes, hurricane, flooding, storms, explosions, infestations), outbreak, or epidemic; (c) war, invasion, hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest; (d) government order or law; (e) actions, embargoes or blockades in effect on or after the date of this Agreement; (f) action by any governmental authority; (g) national or regional emergency; (h) strikes, labor stoppages or slowdowns or other industrial disturbances; and (i) shortage of adequate power or transportation facilities. The Impacted Party shall give notice within 10 days of the Force Majeure Event to the other party, stating the period of time the occurrence is expected to continue. The Impacted Party shall use diligent efforts to end the failure or delay and ensure the effects of such Force Majeure Event are minimized. The Impacted Party shall resume the performance of its obligations as soon as reasonably practicable after the removal of the cause. In the event that the Impacted Party’s failure or delay remains uncured for a period of 30 days following written notice given by it, the other party may thereafter terminate this Agreement upon written notice. Let Destiny Design Inc. shall be entitled to keep the non-refundable retainer and all other payments made by Clients for services rendered by Let Destiny Design Inc. up to the point of proper Notice of a Force Majeure Event.

LABOR CHARGES 

Any and all additional hours spent by staff of Let Destiny Design Inc. While on location doing things that were not listed in the contract/agreement will be billed after the event at a rate of $50/hour per staff member. 

 

HOLD HARMLESS  

Customer agrees to assume the risk of and hold Let Destiny Design Inc. Harmless for any and all damage to persons or property caused during loading, unloading, pickup, delivery, use, or by the goods whether used properly or improperly and/or whether such damage arises out of Let Destiny Design Inc. Negligence. We are as careful as possible, but due to the nature of our work, we are not responsible for damage to linens, chairs, arbors, tables, buildings, venues, etc.
